Conditions

Applicability

These terms and conditions relate to all expressions, services, products and materials of the Amsterdam Kliniek. If there is a specific agreement, such as a treatment agreement, they are deemed to be part of this agreement.

Definitions

Amsterdam Kliniek: The user of these terms and conditions, located at Stationsstraat 6 E in (1391 GN) Abcoude, registered with the Chamber of Commerce under number 33262304

Counter party: customers, suppliers, employees, exhibitors, students, social media contacts, visitor clinic

Expressions: any communication from the Amsterdam Kliniek, regardless of form and medium, such as website, written and oral information, facebook posts, photos, printing, etc.

Materials: photos, video recordings, advertising and promotional materials, etc.

Services: treatments, treatment methods, courses, information, presentations, sales and promotion of products

Products: Used and delivered products by the Amsterdam Kliniek

Delivery

The Amsterdam Kliniek’s expressions, services, products and materials are executed and delivered with the utmost care without unnecessary delay. However, if there are any faults or defects with services and/or products provided by the Amsterdam Kliniek, they will be rectified as soon as possible and in as far as reasonably possible.

Force Majeure

Force majeure means any circumstance beyond the control of the Amsterdam Kliniek, such as fire, flood, strike, exceptional weather or government measures, non-delivery by suppliers of the Amsterdam Kliniek, etc.
Should it not be possible to deliver certain products, services or materials due to force majeure, the Amsterdam Kliniek will suspend delivery and, if possible, deliver as soon as the situation of force majeure has ended. If this is no longer possible, the relevant agreement will expire. The counter party cannot derive rights from non-delivery on the basis of force majeure. The Amsterdam Kliniek is not liable for damages to the counter party due to non-delivery by force majeure.

Termination Agreement

If the counter party does not live up to its obligations towards the Amsterdam Kliniek at all, neither timely nor fully, the counter party has filed for chapter 11 or is going bankrupt or has applied for these or its possessions have been seized, then the Amsterdam Kliniek has the right to terminate the relevant agreement without notice of default while retaining the claim for damages.

Intellectual Property Rights

None of the expressions, services, products and materials of the Amsterdam Kliniek may be copied or otherwise multiplied digitally or analogously without explicit written permission. Such permission may only be granted by Lydia Boeken and may be requested via info@amsterdamkliniek.nl.

It is also forbidden to change the content of the website or other social media. Copyright applies to the information provided by the Amsterdam Kliniek (including video and audio material) on the website or in social media, from either the Amsterdam Kliniek or from the Amsterdam Kliniek suppliers. It is therefore strictly prohibited to copy and/or otherwise reproduce such materials.

If the counter party provides information (in whatever form) via the website and/or social media, it is assumed that there is no copyright applicable, unless explicitly stated. If this is not explicitly stated, the Amsterdam Kliniek is free to use such information.

Liability

In spite of the fact that the utmost care is taken to represent all expressions, products and services offered by the Amsterdam Kliniek in a realistic way, total satisfaction cannot be guaranteed. The Amsterdam Kliniek is in no way liable for any direct or indirect damages resulting from or related to (the use of) the information provided or services and products rendered by the Amsterdam Kliniek, unless stated otherwise by law.

Referrals to other websites, apps or companies are for the information of the reader only. The Amsterdam Kliniek can neither guarantee the content and functioning of external websites or companies, nor can it guarantee the quality of any products and/or services offered there. Any liability relating to websites, apps or companies that are not owned the Amsterdam Kliniek will be rejected.

Personal Information

The counter party agrees with the possible storage of personal information already provided or yet to be provided in an electronic file (such as the electronic patient file) and the mailing list of the Amsterdam Kliniek. The registered data can be used for a variety of purposes, such as the realization of statistics, registering treatments or purchases, etc. The counter party explicitly authorizes such use. Use of promotional and advertising data requires separate consent of the counter party. The Amsterdam Kliniek is responsible for these digital files. If the counter party wishes a copy of (parts of) his/her medical file, a written request must be submitted, accompanied by a copy of a valid ID. The request can be made to Lydia Boeken by post (Kortenhoefsedijk 205, 1241 NB Kortenhoef) or by e-mail (info@amsterdamkliniek.nl). The dossier will be sent by registered mail to the counter party. The Amsterdam Kliniek may charge for providing a copy of (parts of) the medical file. If someone else asks for a copy of the medical file, the explicit consent of the counter party is required.

Prices and Payment

Some of the prices for services and products are listed on the website. The counter party counter party is obliged to pay the amounts published on the website to the Amsterdam Kliniek as soon as he or she proceeds to make use of a service or makes a purchase a product. Any discounts must be made in writing/digitally by the Amsterdam Kliniek prior to using a service or purchasing a product. If this is not done, the Amsterdam Kliniek assumes that the counter party agrees with and is aware of the published rates and is obliged to pay the full amount. The Amsterdam Kliniek is entitled to request an advance (partial) payment in the case of certain services. If such prepayment does not take place, the Amsterdam Kliniek is not required to provide the service. If the counter party returns after a service/treatment or product purchase for a follow-up treatment/service or product purchase, including improvement or correction of the prior treatment, the Amsterdam Kliniek is entitled to use the applicable rates as published on this website.

Return Policy

The Amsterdam Kliniek sells food supplements and skincare products such as cosmeceuticals. It has a no-questions-asked return policy allowing a product to be returned within 30 days from the purchase date. The product needs to be in its undamaged, unopened and original packaging. Return postage is at the expense of the counter party. Reimbursement of the purchase amount will happen within 14 days after receipt of the returned product. Exception to this rule are products that need to be refrigerated; these items cannot be revoked and returned.

Complaints

If the counter party is not satisfied with a treatment/service or product, the Amsterdam Kliniek follows a clear trajectory in order to address the complaint. Please refer to the complaints procedure.

Changes

The Amsterdam Kliniek is free to change these Terms and Conditions at all times. After any change, all previous versions of the Terms and Conditions will no longer apply. In the event that any provision of these Terms and Conditions is unenforceable according to the law, the remaining provisions will remain in order and the relevant provision shall be amended as soon as possible in accordance with the law.

Applicable Law and Forum Choice

Dutch law applies to these Terms and Conditions. Any disputes will be submitted to a Dutch judge.

Cancel and No-Show

It could happen that an appointment needs to be cancelled. The Amsterdam Kliniek offers the possibility to cancel an appointment free of charge, but only under certain conditions:

Integrative medicine intake: at least 48 hours in advance; if less than 48 hours, € 75, – will be charged;

Follow-up integrative medicine: at least 24 hours in advance; if less than 24 hours, € 60, – will be charged;

Blood draw: at least 24 hours in advance; if less than 24 hours in advance, € 60, – will be charged;

Medical cosmetic treatment: at least 24 hours in advance; if less than 24 hours in advance, € 60, – will be charged.

In the case of a no-show, € 60, – will be charged with the exception of an integrative medicine intake: in this case the cost is € 75, -.
